I was working with a travel-based BPO company in Gurgaon as a Travel Sales Consultant for the last two years. Due to a sudden decline in my husband's health (for which I have relevant proof as he is suffering from a major communicable disease), I was unable to focus on my job. My presence was required at home, and I decided to resign. However, the company had guidelines requiring a one-month notice period, which I couldn't fulfill due to unfavorable circumstances. My husband and I live on our own in Delhi, and I resigned via email. My team leader was aware of the situation, as I had been attending doctor appointments. However, I didn't receive any response from my team leader regarding the resignation email, which was supposed to be forwarded to the HR department.

I then sent an email to HR after three days, but again, I received no response. I followed up with them over email after another three days. Later, after two days, I received a reply stating they were unaware of my situation. Since I didn't serve the notice period, they wouldn't proceed with my full and final settlement formalities, and my status in their records was marked as absconding. Upon receiving this email, I immediately went to my office to speak with the HR personnel. The head of the HR department was blunt. Even after explaining my situation with all the doctor's prescriptions and test reports, he straightforwardly said they wouldn't provide me with the relieving letter or clear my dues (which include my January and February incentives). Instead, he asked if I could pay them half of my salary amount; only then would he provide the relieving letter without clearing any of my dues. This left me shattered, seeing the insensitive attitude of the HR department, which is supposed to address employees' grievances.

I need to lodge a formal complaint against them in the labor court or labor office. Please help and guide me in obtaining my relieving letter, experience certificate, Form 16, and dues if possible.

Dear Vidhivani,

In your long post, two significant factors emerge. One is that you did not serve the notice period, and the second is non-payment of wages, which is an incentive for January and February.

Why did you not apply for Leave Without Pay (LWP)? You could have taken 1-2 months of LWP and continued with the employment. Anyway, you may make a formal complaint to the labor office in your area. Please carry with you evidence of your employment.
