Hello Sir/Madam, this is Jyothi. I'm working as an HR Executive in a company. I want to know if an organization wants to terminate an employee due to misconduct, how many days' notice should be given to the employee? Is there an option to terminate an employee immediately without prior notification?

A lot of discussion has happened earlier on handling employee discipline. You could have searched this forum. Anyway, you may click the following link. It provides information on the sequence in which we should handle matters of employee indiscipline:

Termination for Misconduct Under the State Shops and Establishment Act

Under the State Shops and Establishment Act, it is generally provided that no notice is required to be given while terminating for misconduct. However, this should be done after a proper domestic inquiry. Similarly, Model Standing Orders also provide guidance on this matter.

The misconduct should be as listed in Misconduct as in standing orders applicable to the establishment (certified/Model)..... The procedure is explained in Sec;14 of Model Standing orders
