Dear sir/ Ma'am,
Through some reference I got this information that, if all the employees are getting salary above 15000/- Per Month than organization need not to register in PF.
Is this a right information, as in our company only 2 members whom we are paying below 9000/- Per Month and rest others are getting salary above 15000/- per month?

Dear Madam,
Irrespective any salary if the over all strength of your establishment including your all branches exceeds 20 and more your establishment required to register under Employees Provident Fund Scheme, 1952. Accordingly who are drawing below Rs.9000/- restrict to ceiling of Rs.6500/- (now it is proposed increase to 15000 per month. If salary drawing more than 15000 per month you can restrict to ceiling. But in any case if the strength is exceeds 20 you are required to apply for registration and get your establishment code from EPFO.

Dear sir/Ma'am,
I have gone through one tread which was PF related matter & in that tread seniors suggested that, if employees basic salary is more than rs. 6500/- than PF is optional for the employees.
In our company all the executives are drawing more than rs. 6500/- basic salary. In this condition are we still eligible to register in PF?
I am confused, please suggest.

Dear Mr.Sangarsh,
Any establishment is engaging 20 or more on any day are covered under Employees Provident Fund Scheme, 1952 and both employees and employers contyribution are to be deposited with the EPFO. This is the employers responsibility to register with EPFO and get establishment code and start the deduction from the date of registration at least. Otherwise, in the process of any inspection by the Enforcement Officer, EPFO, employer will be liable to pay the both side contributions from the retrospective dates of joining of the employees along with penalty and interest. Violation of any law or failure of implementation definitely will attract the penal clause not only in the PF scheme but also in all labor laws.If you are knowingly avoiding the implementation of scheme then be ready to face the consequences. Do not go that extent and implement the scheme.
