Which Gross will be celling for ESI calculation Like FIxed components Gross or Earned Components Gross

For the eliegibility fixed gross would be considered. But in actual he/she continiously getting lesser than the prescribed amount for more than 6 months, it would attract ESI contributions.

All components including any allowance are to be included under ESI wages(upto Rs.15000)

Dear Mr.Akbar,

As per sec 2(22) of the esi act all emoluments other than those excluded under the act-Washing allowance,conveyance / travelling allowance-any additional remuneration being paid within a periodicity of 2 months are to be taken for purpose of coverage and contribution.
2.OT should be included for contrbution but NOT for deciding coverage.
3.Once the employee is covered in a contribution period even if his wages exceed in between, the coverage and contribution should continue till the end of the contribution period. To elaborate, if an emplyee is paid Rs.15000 in april he is to be covered under the esi and even if his wages exceed 15000 due to any wage increase-periodical increment or any other reason- he should be continued to be covered till the end of sep and contributios are to be paid on the total emoluments -not restricting to Rs.15 K.
