I am working in a Pvt Ltd Company for more than 7 years. I am having a query related to PF deduction. I got my company's PF information from PF's site and came to know that they are not deducting my PF, only few employees PF is being deducted by our employeer. The appointment letter also stated that they will deduct PF. Kindly guide me what can I do (practically and legally) as my company is not deducting PF from my salary and deducting from other employees only.

Please contact your HR Department regarding your query. If they are not giving any proper reply then you can approach the PF Enforcement Officer of your area who is very well available in Baroda itself. He will come for inspection to your company and make sure that all the employees PF is being deducted.

couveryAs explained by Mr. Bhasker, do not over think and assume yourself and better to first consult with your HR Dept. and then only come to the conclusion and decide for the further steps as there may be possibility that you are working for the same company but on third party Payroll and the PF from your salary submitted by that party....so do not indulge in may be or may not be but consult your HR to get rid of confusions.

Or is it that is it deducted but not paid to the pf department ?
(Check your wage slip)
If it is not being deducted, why did it take you 7 years to realise.
Also, are you a exempt employee under the act ?
You need to check all this before going to the pf office with a complain

Contact your HR Dept and take information. But it is surprising that you have raised these questions after 7 years. Might be you are been carried away
by anyone wrong informantion or guidance. Be careful befor pointing fingers at your Company, who has taken care of you all these seven years

Please check the basic amount of your salary if it is below Rs. 6500/- or more than Rs. 6500/- if your basic is more than Rs. 6500/- p.m. there are chances that you are covered under exempt employee. If the basic is below Rs. 6500/- then check the employee strength on roll to give you appropriate answer to your query.
