I have been working with an organization xyz, I have resigned on 30th may 2013 due to some internal issue,according to company’s policy I supposed to serve 1 month notice period but my reporting manager and hr called me and inform me that I don’t need to serve my notice period but they dint gave me any written statement for the same, It was just a verbal communication between us. I dint ask them for any written statement for the same as it was my first job and I dint have much more knowledge about that.

1. My first question is can I claim my notice period salary (June )?

31st may they asked me to sign F & F form, from where I had to take all the clearance signature from all the department including accounts dept. there was written after 3weeks I will be getting all the settlement amount and release letter. After 4weeks I mailed my hr to know the necessary updates from him, and next day I got a mail from my hr and accounts dept that I have 17days of LWP(Loss without pay) in the moth of may and I have to pay that amount to get release letter and PF, reportedly I have called them and mailed them by saying that I left organization on 31st may 2013 and till 31st may my LMS was updated as OD(on duty), which has been approved too and the shocking thing is this all things known by my reporting manager and HR .

After sometime my 3 HR had called me (A,K,V) and they gave me different different statements,

>Mr. A said that I have total 9 LWPs .

>Mr. K said that they revive my all ODs and made them LWP.

>Mr. V said I have total 17 LWPs, and if I don’t pay so they will take legal action against me.

2.My 2nd question is they can revive my LMS? how can they revive all ODs as LWP?

As per my knowledge LWP deduct from the salary amount, whereas in the moth of May I have got full salary.

Few days ago I came to know that they did the same thing with one more girl in our organization.

Respected people please help me to find suitable solution.

Dear friend,
First of all, you should not sign yr FF statement without experience letter. Secondly, any company can not hold your PF so dont worry abt it. If they hold your letter and PF, you just go to ALC(Assistant Labour Commison) office and describe the same what had been happened.
You will go ALC only when , they dont release your letter ok.
For PF you are entitled for withdrawal if you have did more than 6 months duty.
If u have done more than 6 months duty, you are eligible for PF withdrawal as well as transfer.
For withdrawal you have to wait for 60 days after your re leaving.
