Dear All,
While fixing Office opening and closing timings, for Office staff, is there any compulsion on Management, to make a rule which allows grace period / late arrival, for joining duty in the morning.
If yes, what is the minimum time to be allowed for late arrival ?
If no, what can be penalties, if an employee reaches after Opening hours ?
I am asking what law or act says, whether it is compulsion or non-compulsion to offer Grace period.
Practically, we all know that no management is strict on this issue, looking at the genuine difficulties, everyday employee has to face, to reach office.
I would like members to share views considering a Company registered under Bombay Shops & Establishment Act.

Members are requested to disclose any rule or law about grace period allowed to morning joining hours.

Nothing is compulsory. However, the grace period is nothing but leeway considering traffic situation in most of the cities.

I do not know what type of industry you are from however, you may make eight or nine hours of work compulsory irrespective of time at which the staffs report for their duties. This facility of flexi-hours strikes a balance between late coming and their number of hours at the work. Employee may come even one hour late but he/she works late for the corresponding period. Most of the IT companies work on this basis.

However, this facility cannot be given to those work on shop floor, in shifts or handle jobs related to customer service.

Is there any requirement in your company that mandates managers to attend the morning meeting? In that case also facility of flexi-hours cannot be extended to them.

To avoid traffic blues, I know few companies who have kept their working hours from 0800 to 1600 hours. However, these companies provide breakfast and this breakfast must be finished before 0800 hours.

Dear Abhay;

It is the Industrial Employment (Standing Orders) Act specifying the rules for attendance. The hours of work are to be seen in two ways - first is the quantum which cannot be for more than 48 hours in a week and cannot be more than 10 hours a day. Second is the clock time from what time to what time. These clock time is decided by the employer taking into account the convenience of employees, train timings, etc.

It is possible that an employee is late. Reasons can be many - within his control or out of his control. Employer need not worry. For employer work discipline is important. Coming late upto 15 minutes on maximum 3 occasions within a month is pardonable. If one comes late on the 4th occasion, either half day wages are deducted or the employee is shut out i.e. not allowed to work for the first half of shift. Some employers follow this only for the production workers and not for office staff, whose work is not linked to time.

Off Timing - 08.00 Am To 05.00 PM
Grace Time : up to 08.10 AM
Grace Time is Allowed for 3 times in a Month - 4th late would be Half a Day Lop

There is fortunately no law compelling grace time. All have to report at the work-commencement time fixed in standing orders.
Leeway depends only merits; for example, there is heavy rain,bundhs, accidents and such vis major causes.
Supervisors have to play role model by being on time. Otherwise, there is no point in talking about rules.
As Mr. Dinesh mentioned close the canteen, or control company transport, if you have one, before shift time etc. Ensure that the union, if it is present is also in the loop and supports you.
