Dear all, good morning.

An employee applies for EL on the 13th, 14th, and 16th of August. On the 15th, it is Independence Day, so it is a Central Government-declared holiday. On the 15th, will he be given leave (LWP), holiday, or EL?

If an employee applies for EL on the 15th, 18th, and 19th of October (15th is Saturday, 16th Sunday (w/o), 17th Monday Vishkarma Puja holiday declared by my company), how many EL days should be given to him? Whether the W/o in between ELs counted as W/o, LWP, or EL.

What about the 17th company-declared holiday... Is it LWP, EL, or Holiday? Please clarify this.

Hello,

When an employee is on continuous leave, and the leave is split in such a way that it surrounds a national holiday, the national holiday will be counted as part of the leave as far as PL/EL is concerned.

Dear Sowjanya,

There is a little difference between Casual and Earned Leave. In your case, if the employee had taken casual leave on 14th and 16th August, you wouldn't have counted the 15th as CL. But in the case of EL, the 15th would be considered as an Earned Leave availed.

Regarding the case in October from 15th till 19th, this employee will be considered on earned leaves. To save him, you may ask this employee to come in the second half of Saturday (15th October), else he/she will be losing 5 ELs from his account.

Normally, companies establish leave rules that vary from company to company, and there are no legal norms. I don't know if you have set norms for your organization or not. In case you do not, you can align with what Umesh has written or with what your HR head has decided.
