Dear Amit,

This is called as LTS (Long term Settlement) and not LTA. Generally LTA meant for Leave Travel Allowance which will be as a part of Benefits to employees as per company policy.

LTS :-

Long Term Settlement (LTS) is the process of negotiation between the Management and Union or group of employees representative (Minimum representation of 5 Persons). Union or Representative of employees will submit the charter of Demand from the employees with regard to their salary hike in each and every component and other benefits such as leave, canteen, uniform, shoe LTA, etc., On receipt of the same Management will submit the demand from their side about the productivity, reduction of Wastage, Minimise the Power consumption disciplinary and other matter as deemed fit by the Management.

After that they will have bilateral discussions and finalize and signed by both parties by way of settlement under section 18(1) of the Industrial Dispute Act.

In case It was not settled between 2 parties, then any one party can approach Labour Department for amicable settlement and they will conduct conciliation proceeding and arrive settlement. In such case they prepare the settlement under section 12(3) of the Industrial Dispute Act.

Hope you got clarified

All the Best

If there is no mutual consent then other party can approach concern Labour Conciliation Authority

whatever be the nomenclature you give to the process of negotiation between the managment and the union- whther long term agreement or long term settlement- the law names it as only settlement under Sec.2(p) of teh Industrial Disputes Act and if it is not, it is not a settlment. Then a settlement can be entered into by the parties in two ways. Either before the conciliaton officer (Labour Commissioner)or by the mangement and the union themselves without involving concilaitaion officer. If you eneter into an agreement without involving conciliation officer, such settlement is binding only on the union who signed it.However the legal postion may change if such union is a recognised union under law. It is difficult to visualise every conceibavble problem in the course of collective bargaining and provide solutions here.

i endorse the views expressed by Mr. B Saikumar Nomenclature doesnot change or effect the legal status of the word mentioned (Settlement) in the ID Act

Dear sir,
There is no long time agreement for LTA. In the appointment order, the co. may specify the LTA amount eligible for in a year or once in two years as the case may be.
You have to sanction the same after obtaining the tour bills.
