Dear all,

I am enclosing the ESIC notification in which it is clearly mentioned that the coverage includes shops, hotels, restaurants, road motor transport establishments, cinemas, newspapers, educational institutions (private, public, aided, partially aided) run by individual trusts or societies, medical institutions, hospitals, nursing homes, diagnostic centers, and pathological labs. These establishments are now covered if they have 10 or more employees on any day of the preceding twelve months. This regulation is effective from 01.04.2011.

The notification is for shops, etc. But does not talk of offices (commercial establishment). so does this mean offices still don’t need to do this till they have 20 employees ?

Yes, of course, that word was missed. But in the earlier notification, you can spot the phrase "non-factory establishments." I am also waiting for our fellow members' comments on this.

Dear All,

Our company has an employee strength of 150+ but we are not providing PF benefits to our employees. Can someone share basic knowledge regarding the same?

While consulting with the HR team in the company, they informed us that with a minimum package of 6600+, employees can skip these benefits. Is it really possible?

Dear Kirti,

As per PF Rules, all employees will be covered under PF if their BASIC+DA is less than 6500/-, and it's mandatory. So, if you explain your pay structure as a "minimum package of 6600+" then it will be easier to provide details.

Dear Mr. Sethupathy,

The present notification issued by the State Government concerns Section 1(5) of the ESI Act, 1948. By virtue of the amended provisions, all non-power establishments, whether they are shops, commercial establishments, road transport establishments, educational and medical institutions, etc., where a service is provided for a price and employing 10 persons, irrespective of their salary limit, fall under the provisions of the Act.

In Andhra Pradesh, this has been effective since 15-04-2011, while in other states, it depends on the date on which the relevant notification under Section 1(5) is issued by the concerned State Governments. I hope this point is clear.

You mentioned notification by the state government. I think that was the State of Delhi. Please let me know how I can find the notification for other states. Also, what would be the effect of the term "commercial establishment" being omitted in the Delhi notification?

Guidance Needed on ESI and PF Facilities for Employees

I am Azad Singh, working as an assistant professor in a private college, seeking your guidance. There are more than 50 people working here, and the institute is governed by a trust. There are many institutes engaged in similar activities, producing numerous engineers and management graduates. However, teaching and non-teaching employees are deprived of ESI and PF facilities.

ESI Act Extension to Educational Institutions

I wish to inform you that, to the best of my knowledge, the relevant government has issued a notification extending the provisions of the ESI Act, 1948, under section 1(5) to educational institutions. This includes public, private, aided, or partially aided institutions operated by an individual, trust, society, or other organization employing 10 or more persons in the National Capital Territory, Delhi. For further information, the appropriate office of the ESIC can be contacted. For coverage under the EPF&MPs Act, 1952, the relevant office of the EPFO can be contacted if desired.

However, it would be even better if you could provide the name of the state in which the said educational institution is situated.
