I resigned on 31.01.2011 and submitted the hard copy of the resignation letter to my immediate superior after discussing it with him. I also emailed copies of my resignation to him, our Head of Department (HOD), and HR on the same day. However, I have not received any response from my immediate superior to date. I have reminded him to either counter-sign the resignation letter or acknowledge acceptance via email.
If he accepts the resignation on 10.02.2011 (for example), then my notice period of 40 days from the date of resignation will be applicable. Please advise on this matter.
If he does not accept the resignation, please provide guidance on the next steps.
I am determined to leave my current company. I would appreciate your expert advice on how to proceed.

The notice period starts running from the day your resignation letter reaches the table of the reporting officer. If it is sent by post, the communication is considered complete when it is posted and not necessarily when it is delivered at the other end. However, companies without robust HR departments may potentially harass employees by claiming that the resignation was not accepted, and therefore, the notice period would start from the date of acceptance. Hence, a generalization in this regard is not feasible. Moreover, aspects such as notice pay and the period of notice, if not outlined in the Standing Orders, may be interpreted differently by various individuals.
