Dear Mr Jadhav. The Shops and establishments act differs from state to state and the leave policies also . Hence please refer the states enactment in which your company is located.

Can anybody explain to me the provision of leave under the Shop & Establishment Act? As per Chapter VII, Section 35(1) of the act, every employee who has been employed for not less than three months in any year shall, for every 60 days on which they have worked during the year, be allowed leave, consecutive or otherwise, for a period of not more than five days.

My question is whether it is mandatory for the employer to give 5 days of leave for every 60 days of work, i.e., 2.5 days of leave per month, as mentioned in the act, or if they can give less than 5 days of leave as stipulated.
