Hello,

My company is registered under the Bombay Shop Establishment Act, but the registered office of the company is situated in Ahmedabad, Gujarat. So, to draft a leave policy, which act should I follow? Should I follow the Bombay Shop Establishment Act as it is registered under the same, or should I follow the Gujarat Shop Establishment Act since the company is situated in Ahmedabad, Gujarat?

Please guide me on this matter.

Thank you.

Shops and Commercial Establishment Act is a state Act and therefore, the respective state Act should be followed to draft leave rules ( and other conditions of services of employees)

Your Mumbai office has to follow the leave policy under the Bombay Shops and Establishment Act, from which you obtained the registration. So, to draft the policy, you should follow the provisions of this Act.

On the other hand, your Registered Office falls under the Gujarat Shops and Establishment Act since it is located in Ahmedabad, Gujarat. Therefore, the leave policy for the Registered Office will be governed by the Gujarat Shops and Establishment Act.
