First of all, what is the work done by the contractor? Is he a labor supply contractor or a piece-rate work contractor?
Please analyze why the contractor has run away. If his desertion is justifiable, please reconsider your contractual agreement with that contractor.
Your company will be holding the retention amount up to a certain percentage of his bill, whatever is paid to him. You can use this amount as leverage.
When engaging with the contractor, you can create a specific agreement for the acceptance of the contract. Initially, you can establish a penalty for any breaches.
Every month, you must request details regarding wage disbursement, PF remittance, workmen compensation policy, and any other relevant statutory documents as deemed necessary.
In the construction industry, the majority of contractors (manpower supply) are illiterate and lack sufficient educational qualifications to understand. These are the types of cases we have to deal with, and runaway contractors may be deterred from future jobs with your company by publicizing their breach of contract or involvement in activities against the company's interests.
