First, decide under which Act you are to grant leave, and then go through the applicable rules, i.e., central or state of that Act, to find out the format of maintaining the leave register.

Although the Contract Labour (R&A) Act does not provide any provision regarding leave. In the absence of this, it depends on the establishment in which you have deployed your workforce. Because all laws applicable to the Principal Employer will also be applicable to contractual workmen. If the Principal Employer is covered by the Factories Act, then they need to give leave and maintain leave records as per the Factories Act. If the Principal Employer is covered by the Shop Act, then leave needs to be given as per the concerned Shop Act of that state and records need to be maintained accordingly. Dear Friends,

The Contract Labour Act does not prescribe a leave register, as rightly stated by our learned friend R N Khola. Leave is granted to contract labour as per the primary law or main law applicable to them. If they are working in a factory registered under the Factory Act (FA), then as per the FA. If they are working in a commercial establishment, then as per the Shops and Establishments Act (S&E Act). Primary law or main law refers to either the FA, Mine Act, Dock Act, or S&E Act. The leave register is to be maintained as per the applicable primary law or main law.
