I would like to know if employees can avail leave during their notice period (1 month). If they take long leave during the notice period, are the companies supposed to extend their notice period?

Hi Ruchi,

It all depends on the relationship the employee has with the company. An employee is expected to give a notice period so that they can complete their work and hand it over to someone else. You can either:

1) Adjust the person's leave against the number of leave balance they have.
2) If they have no leave balance, then deduct the pay.
3) Or simply extend the date.

Choose whichever option suits both parties.

I believe that the notice period is given as Asha said, to complete your current tasks and hand them over to the right authority. Has the employee's long leave been approved or taken without informing? Ideally, we deduct the salary or balance leaves if taken during the notice period.

Hi Ruchi!

Yes, the employees can take long leaves during the notice period if they have leave balance. This is a right of the employee as per most company policies. However, it varies from company to company. In my company, we adjust the total leave balance of the employee's tenure with the company against the notice period. Therefore, the employee serves a notice period of:

Total notice period (let's say 30 days) - leave balance (number of days) = Actual notice period to be served by the employee.

The rest depends on the company's policies. Some companies have a clause that prohibits an employee from taking any leave during the notice period. In such cases, the notice period is extended by the number of leaves taken by the employee.

Sapna Kale & Neha have already answered your query. The employee can avail the leave as long as their employer has no issue. As said before, the point of giving a notice period is to complete the given work & hand it over.

It would be ideally good if the employee doesn't take a leave, or else what is the point of giving a notice period? Still, if due to some unavoidable reason the person has taken leave, you can make adjustments in their salary as mentioned above.

Hi Valsan,

Sending a medical certificate through the company mail ID is acceptable, but when he commences his duty, ask him to submit the original copy of the certificate. Resignation letters are also accepted when sent by the company mail ID.
