Hi all, I was terminated from the comapany due to unknown reason. I was paid one month salary but HR is refusing to encash the Privilege Leave. Please help me!! is there any way to get this? Thanks,

Whether you are terminated or resigned, encashment of leave should be provided at the time of full and final settlement. This provision is stated in most shop and establishment acts as well as the factories act. Some shop and establishment acts, like those in Delhi, Haryana, and Punjab, do not have encashment provisions. Now, could you please specify whether you were working in a factory or a shop and establishment in which state?

The HR persons at BPO may not be a qualified one and not aware of the rules. You are eligible for PL encashment. Pls approach the area labour commissioner.

I have resigned from the organization on the 11th month of my joining date. I am serving a notice period of 2 months. I was informed by HR that paid leave (PL) is applicable only after 12 months of service. However, since I have submitted my resignation before completing 12 months, I am not entitled to PL encashment. I have reviewed the company employee handbook for any such clause but couldn't find it. Please advise on what is correct and provide me with any references to the law that are applicable in this case. I am working in Gurgaon and come under the Shop and Establishment Act.
