Hi, I would like to know what is the purpose of Form 11. I came across a few posts on this but could not gather a definite conclusion. Currently only those employees whose basic is less than 6500 are covered under PF in my organization. Does Form 11 need to be filled by existing employees whose basic is more than 6500 also, irrespective whether they had PF in their previous organizations or not? If yes, then does signing Form 11 mean that the employee is giving a declaration that his basic is above 6500 and he voluntarily does not want to opt for PF? Regards, Mavis

Dear, It is a declaration by a person taking up employment in an establishment in which the Employees’ Provident Fund and Family Pension Fund Scheme are in force. It is doesn't mean he can't opt out of PF. as i said earleir it is simple declartion made by the employee about his previous employment(that he was the member of PF/or not). see if he has salary more than 6500 there, he will remain be the member of PF with ur org, if he hasn't withdrawal his PF. Dear Sirs,
Can any one kindly let me know as form 11 in pf is to be filled when:
1) Suppose recently one employee has joined our organization but if he has not withdrawn his earlier pf but still wants PF exemption in present company (Our organization). So is he eligible to make declaration in form 11?
2) Secondly if a fresher has joined a company and if he wishes to exempt himself from being a member of PF by filling form 11 (Salary being more than 6500/-). So is he eligible to make declaration in form 11?
Kindly guide.

Continuing the above discussion... 1.No he is not entitled for PF Exemption. 2.Yes he is eligible for PF Exemption.

Dear Deepak,
Once a person is enrolled under PF Scheme, irrespective of his salary increments in consecutive jobs, he does not have an option of exemption from the scheme, unless the company is not registered under the statute.
On the other hand, if a fresher joining his first organization with Basic + DA above Rs. 6500/- can opt out of the PF scheme. However, he has an option to join the PF Scheme in his future organizations.

Hello All,
My question is a little different from the topic here but still related to PF & ESIC. I just did not want to create another thread.
My company is covered under both PF & ESIC. I am recruiting engineers as Trainees and at least for 6 months they will be under probation. During this 6 months I do not want them covered under anything PF or ESIC. till the training period. Is it possible? As what happens is most of the time the candidate after few days or a month or so vanishes. So all the procedure done is a waste. How can this be done.

Welcome this query!I too initially in dark with this provision.But now squired the exact solution.
See,The Trainee you are talking about are under the purview of Certified Standing order or Model Standing order for the class Apprentice.The payment you are paying them shall be Stipend and not Wages.Therefore you can exclude them from PF and ESIC.I strongly recommend you to get certify your standing order and enlist all this provision for apprentice like ,their stipend,training period ,safety ,leave etc.
