At the outset, I wish you a very Happy New Year. I would like to know if it is compulsory that Casual Leave cannot be taken for more than 3 days continuously. If yes, please specify the reason. In our company, if an employee is on leave for more than 3 or 5 days, we combine this leave into Casual Leave. Please help me in drafting the Leave policy.

I think there are no hard and fast rules that only a maximum of 3 days of CL can be sanctioned. A maximum of 10 days of CL, inclusive of any public holidays or weekly off, can be sanctioned. If there are no public holidays, a maximum of 9 days of CL can be sanctioned as one Sunday falls in between.

Basically, casual leaves are not mandatory by law; it is a mutual understanding between management and employees. Logically thinking, casual leave can be availed only in circumstances that arise suddenly, such as any ceremony, function, death of a relative, hospitalization of a friend or relative, etc. Therefore, it may be availed for 1 to 2 days. There is no specific rule, but logic applies. This type of leave is typically integrated into the organization or factory through settlement agreements with unions. Otherwise, if casual leave is not monitored in the organization, it does not matter.

Earned leaves are mandatory under The Factories Act, which is 1 for every 20 working days subject to completion of 240 days.
