1.Sir, There is no concept of "20 km. radius from Esi office" in ESIC. In case any area is implemented areas under section 1(3) of the ESI Act, 1948 and rules/regulations framed thereunder, then all units located in said area are coverable provided the units employ minimum number of persons as per provisions of said Act. In such situation, even if an area is located more than 20 KM radius from ESI Office, even then it is coverable and compliance is required to be made.

2. However, ESIC always tries that ESI dispensary should be within reasonable distance from area i.e. within 6 to 10 KM distance depending on locations and means of conveyance etc. In case, any ESI Dispensary is located at a distance more than 10 KMs, then the representatives of insured persons or employers can represent to ESIC or State Govt. for immediate opening / start of ESI dispensary for the said area. At some places, it can be found that the ESI dispensaries are not in industrial areas, but at the nearest town where the covered insured population resides. However, in such situations also compliance is still required to be made.

3. Exemption provisions are available under Chapter VIII of said Act and are applicable in such cases where the employees are "in reciept of benefits substantially similar or superior to the benefits" provided under the said Act.

4. As suggested by Madhu ji in his remarks above, you can confirm from nearest ESIC Branch/Regional/Sub Regional Office, whether the area in which your unit is located is implmented area or not .
