What is the criterial for payment of Subsitence allowance.
Normally we pay 50% on first 90days, and 75% upto 180 days and full salary till suspension is ended , my question is
1) What will be the minimum period required to pay the suspension allowance. say for suppose we suspends an employee for one week (do we still needs to pay suspension allowance to him)
2) If suppose , we suspends an employee for habitual late coming or for frequent unauthorised leave or any other reason. Still we need to pay the suspension allowance or the suspension allowance is paid to the employees who are put under suspension for mistake of grave nature

Subsistence allowance is an allowance and it will not be taken in to account in any part of salary.
b) Misbehavior
c) Transgressing standing orders
Suppose, you suspends an employee for habitual late coming, we can give salary cut only and WE NEED NOT PAY SUBSISTENCE ALLOWANCE.
I think this would have sufficient.

Subsistence allowance is an allowance and it will not be taken in to account in any part of salary.
- If an employee issued charge sheet/show cause notice, automatically he will be under suspension pending enquiry (temporarily discharging from work). Till the enquiry comes to an end, we should provide subsistence allowance to the delinquent only through money order.
- Suspension can be given for the following reasons
b) Misbehavior
c) Transgressing standing orders
Suppose, you suspends an employee for habitual late coming, we can give salary cut only and WE NEED NOT PAY SUBSISTENCE ALLOWANCE.
I think this would have sufficient.

1.Mimimum 1 day to Maximum 4 days suspension as punishment is permissible as per Standing orders 1946.This should be after conducting legal & fair domastic Enquiry. This is the suspension as punishment where you do not require to pay wages
2. Subsistence allowance is payable where suspension pending enquiry is ordered. If employee is placed under suspension pending enquiry the rate of subsistence allowance is= 50% wages for first 90 days of suspension 75% wages for next 90 days & 100% wages above 180 days
3. You can suspend an employee for habitual late coming, unauthorized absence or grave mistake for max 4 day. But before doing so you will have to conduct legal & fair enquiry

ESIC & PF both should be deducted in view of the same is part of his gross wages p/a. I my view the arear payment of ESIL & PF contribution need to be done in such case .
