hi nirmal,

as per your request i could understand that you r interested towards statutory compliances... the only best solution is........ you better start learning the labour laws first of all.. try to get a brief on them at least if not in-detail and slowly side by side you can also know the practical implementation of the provisions of these acts..... as a part of it... let me give you some inputs now itself....

1. Provident fund -

a. The provident fund and miscellaneous provisions act is applicable to any organization where 20 or more number of employees are working on rolls

b. There are 3 main things that are covered under this act - PROVIDENT FUND, PENSION FUND & EMPLOYEE DEPOSITE LINKED INSURANCE (EDLI)

c. any employee whose gross salary is less than 6500 is covered under this act

d. contributions

Employee contribution - 12% on basic

Employer contribution - 13.61% on basic

e. now, let us look at the bifurcation of employer contribution

13.61%= 8.33% to provident fund + 3.67% to pension fund + 0.5% EDLI + 1.1 administrative charges for PF +0.01% admin charges for EDLI

4. an employee who works for more 6 months only can either withdraw or transfer his PF contribution.

5. regarding EDLI - if the employee passes away, max of 60000/- could be paid to the nominee

6. there are certain forms used in practical working of this act

a. declaration form - probably you would have filled it when you have joined ur present company

b. form 5 - information regarding the new joinees in a month

c. form 10 - information regarding resigned employees in a month

d. form 22 - challana form which is used to pay every month's return to the PF authorities

*** b.c. & d. forms are to be submitted every month to the PF dept.

e. form 19 - PF withdrawl form

f. form 10c - Pension withdrawl form

g. form 13 - PF transfer

h. form 24 - statement of PF contribution made in that particular financial year - this form will be sent by PF dept to all the companies at the end of every financial year of all the employees who are working in each company

** this is all i know about PF - for more details you can refer to the act or you can visit the above mentioned website.

2. ESI

a. Employee State Insurance Act.

b. it is applicable to all the organizations who are having 20 more number of employees

c. an employee whose gross salary is less than 10000/- per month is covered under this act

d. the employee and his/her dependants can avail certain medical and other benefits provided as per this act

3. Professional tax

a. there are different slabs set for each state

b. for AP

if the gross is < 5000 - P.tax=0/-

5001 to 6000 60/-

6001 to 10000 80/-

10001 to 15000 100/-

15001 to 20000 150/-

above 20000 200/-

** these 3 acts are required in every month activities of a company

apart from these there are other labour laws which are mandatory to be learnt and implemented

Payment of Bonus

Payment of Gratuity

Apprenticeship Act

*** every year labour welfare fund needs to be paid

Hello Sirisha,
Thanks a lot for the detailed information given by you.Appreciate your effort in sharing the information.
As for iam aware,its not only those people who can avail PF,whose gross is <6500 but also >6500 and employer contribution depends on the employer and 13.61% is not mandatory(as its 12% in our company),Form-2 for declaration.
Please correct if iam wrong.
