Greetings,
The company was initially not covered under PF for 10 years and from 1992 was covered under PF. While calculating Gratuity what should the joining date be? Actual joining date or the date from PF coverage?

Dear Santhosh, The applicability of Grauity is independent coverage, under this Act the Actual date of joining with the Organisation will be considered, not the date of PF coverage.

For applicability of Payment of gratuity Act 1972,the only condition is that the
establishment should have equal to or more than ten employees.The definition of
employee is wide and includes almost all irrespective of salary.Thus the date of applicability of Employees P.F.Act is irrelevant.

These two are different enactments. For Gratuity, the actual date of joing shall be taken, PF membership has nothing to do in regard to payment of Gratuity

sir,
if an employee had served his service for 4.8 yrs were as in his last year of 8 months his 240 working day is there can we give gratuity or can an employee go for labour court claiming for gratuity.
Sir if yes plz guide me under which section of gratuity act is mentioned or any amendment is there.
