Hi R.N.Khola,
What types of Leaves applicable who work in a Factory that come under Factories Act. Example is the leave policy equal for Managers, Officers, Sr.Executives, and to that of Workers. I understand only PL leave is applicable. Is CL and SL applicable in a factory if so these leaves are also applicable to workers. Can you please clarify.

Dear Ravindranath,

The worker as defined under The Factories Act, 1948 is entitled to leave with wages as per chapter VIII of this Act. A worker is also entitled to National & Festival holidays and Sick & Casual Leaves under the State Industrial Establishment (N & F and C & S) Act if the State has enacted this Act for workers working in factories. He can also avail sickness benefit if covered under the definition of the employee under the ESI Act, 1948. A female worker can also avail Maternity Benefit under ESI Act or under The Maternity Benefit Act, 1961 whichever the case may be. After finalizing the applicability of the Act we are to go through the definition of the beneficiary i.e. worker/ employee who become entitled to have these leaves. If any of the persons working in factories who is not covered under the definition of the worker /employee whichever is there in the Act then he will be getting the leaves as per the leave policy or Rules of the unit.

You must be knowing that Shops Act is a State Act & therefore you are advised to through your State Shops Act for taking decision on the matter of sick leaves.

You are to go through section 35 on 'leaves' under the Bombay Shops & Establishment Act, 1948. You will find there all types of leaves which are to be given to your employees.

Dear Naresh G.
A number of leave policies are provided by the members at different forums of this site & you can also down load leave policy on this site itself. This is also to inform you that Shops & Establishment Act is not a central Act. This is a State Act & different State Shops Act are having different leave provision. Therefore first see which State Shops & Establishment is applicable in your case & then go through leave provision in that Act & change the leave policy accordingly keeping in view the number of different kind of leaves as are provided in the applicable Act.
