Hi,

I was with "All India Radio" and resigned after a "Continuous Service" of 8 years and 10 months. I was not aware that Gratuity would be paid if the service is more than 5 years. When I contacted my former Employer's Office in Jagdalpur, Chhattisgarh, they informed me that the Pay & Accounts Office in Bombay refused to pay the Gratuity because it was a resignation and not retirement, disability, or death. I want to know:

1. Because I resigned, am I eligible for Gratuity?
2. If yes, because Gratuity has to be paid within 30 days, can I claim any interest?
3. All India Radio was a "Central Govt Dept" until around 1999 (or 1998); later, it became "Prasar Bharathi." Will this make any difference in the Gratuity Payment?
4. Which rule or reference (preferably a book) should I provide to convince them?
