Hi All,

I need some help in terms of the number of leaves that should be given to an employee on a yearly basis as per the Bombay Shop & Establishment Act. Is it mandatory to provide a certain number of leaves to an employee, and are there any categories in which these leaves should be divided, such as "Sick Leave," "privileged leave," etc.?

I request you to help me with all the information regarding leave management.

Hi Prem,

It's me, Dheeraj. In the BSE Act, there is nothing mentioned regarding the classification of leaves such as CL, SL, etc. As per the provisions of the Act, every employee who has been employed for a minimum of 3 months in a year is entitled to 5 days of leave for every 60 days worked, i.e., 21 days of leave for 240 days worked. These leaves are exclusive of mandatory leaves (1st May, 15th Aug, 2nd Oct, and 26th Jan). The accumulation limit is 42 days.

The SL and CL policy depends on the company. However, the 21 days of leave mentioned above are mandatory. Should you need any further clarification, please feel free to contact me at 9322019204.

Hi Dheeraj,

Thank you for the reply. Maybe you can help me with this one as well? Can we reduce the number of annual leave days if we are drafting a new policy, for example, let's say from 21 to 18? Any information regarding the same would be appreciated.
