Hi guys, my sister is working as a nurse, and now she is going to be relieved from her work. When asked about the notice period, they said that the current notice period is 4 months. However, when I checked my sister's appointment letter, it is mentioned as 2 months only. So, which one will be applicable? The management is insisting that she has to serve a 4-month notice period. Is there any solution for this issue or any way to proceed legally? Kindly suggest.

Notice period as per the appointment order will be applicable to any employee. If the management is insisting she serve 4 months, then you can question it. Legally, a nurse in a hospital is a workman coming under the scope of the Industrial Disputes Act. Nowhere in the ID Act is it stated that a worker should give notice if they want to leave an organization. It is true that to terminate an employee, one month's notice is required to be given to them. However, a workman need not give any notice to leave a company. Therefore, bring this to the management's attention and ask them to release your sister in two months. Caution that if they insist on her working for 4 months, the matter will be taken to the labor officer. Once the officer is involved, even a two-month notice period would become illegal.

Dear Karthik, Ask your sister to send a simple letter to her office, that her NP is two months as per the terms of appointment. Therefore, her NP day is till 'Y' from the date of resign 'X'.
