I was on a contract for 4 months. Later, my contract was extended for one month, which lasted until 31st Jan 2021. The 30th and 31st of Jan 2021 were Saturday and Sunday. Due to this reason, I last worked in the company till 29th Jan 2021. However, the company paid me only 29 days' salary for the month of January 2021.

Eligibility for Full Month's Payment

My question is: Am I not eligible for payment for the whole month? The weekly off is my earned off, and the company should pay me for a whole week. Should I log a complaint with the Labor Department for this or not?

If you have all the details in writing and your last working day is mentioned as 31st Jan, then you are eligible for the payment. If they have mentioned that your contract ended on the 29th of Jan or your last working day was the same date they relieved you, then the company is not liable to make any payment.

Considerations Before Filing a Labor Complaint

Are you seriously considering filing a complaint with the labor department for non-payment for a two-day period? How much will you actually recover? Keep in mind that employers often conduct background checks by contacting previous employers. Have you considered the type of feedback they might provide about you?
