Dear Team, I am in need of clarity. We are an engineering-based company involved in HVAC works in Tamil Nadu. We have engaged contractors to carry out the aforementioned works in hospitals, cinema theatres, and malls. What is the minimum wage to be followed for the contract employees? Should I pay them wages under S&E or General Engineering category, or based on the nature of the client's work? Kindly advise.

If the type of employment involves engineering work and is included in the scheduled employment list for minimum wages, then the same can be applied. If any type of employment is not included in the scheduled list of employment notification under minimum wages, then the Shops and Establishments Act wages can be applied.

Technically, the workers are entitled to receive wages applicable to the establishment where they work. Hence, you should pay them the wages that are applicable in your client's establishment.
