Legal Dilemma: Can a HQ Director Be Considered an Occupier Without Being On-Site?

Can a director working in Headquarter and not at the plant site be declared as an occupier.

Presuming the query to be regarding the Factories Act 1948, looking at the definition of 'Occupier' given in the proviso to Section 2(n) of the Act, it is only one of the Directors who can be the Occupier of the Factory.
