We are providing 12 days of EL per year to our employees as per the TN Shops & Establishment Act. Besides this, there are also CL and SL.

With specific regards to EL, is there any minimum limit we need to follow for the maximum accumulated EL in subsequent years? For example, can the EL balance allowed to be accrued by employees be as low as 15 days, or does it have to be 30, etc?

We want employees to take leave during the year itself and only carry forward 3 ELs so they can accumulate a maximum of 15 ELs in the subsequent years. Is this fine?

Accumulation of unavailed portions of earned leave (EL) depends on individual company policy. Some companies allow the accumulation of accrued EL for a maximum of 3 years. Other companies may permit the accumulation of only 50% of accrued leave, with the remaining 50% to be availed before the year-end. Policies vary from company to company. It is advisable to devise a policy that safeguards the interests of both the employer and the employee.
