Hi all,

I am seeking your help for an exemption under the UP Welfare Officer Act. As we have more than 1000 employees, we are required to appoint a welfare officer. However, we do not currently have a qualified person for this role. Can you please advise on the procedure to obtain an exemption under this act? We have employees with over 10 years of experience who have been effectively performing the duties of welfare officers. Your assistance is greatly appreciated. Thank you.

You cannot get any exemption from appointing a welfare officer. If you have people with the qualifications prescribed for the position of welfare officer, redesignate him as Welfare Officer or appoint a new person for that post from outside. If the prescribed qualifications are MSW/degree in law or PG Diploma in Personnel Management and Industrial Relations, then you cannot dilute them by employing a person holding an MBA even from a very reputed institution. An HR Manager cannot act as a Welfare Officer simply because the latter is a statutory position.
