Hi All,

I am the HR of a private limited company. Some of our employees do not want to contribute to the Provident Fund (PF) as their basic salary exceeds 20k, and they did not have PF in their last company. Which form should I have them sign in this case?

Second query: Another employee had PF in their previous company but wishes to withdraw that amount. In our company, they also do not wish to contribute to PF. Can I provide them with the same form as mentioned in point number 1?

Opting Out of Provident Fund Contributions

There is no form prescribed in the Act to opt out, as they are already excluded from the purview of the act since they have crossed Rs. 15k p.m. salary. Whether to cover them as an option is your choice, as there is no compulsion on the employer's side.

Handling EPF Accumulation and Withdrawal

This employee need not worry about encashing his accumulation in his EPF account from when he was serving with the erstwhile employer. He can directly claim from the respective EPFO for withdrawal in the prescribed form. In case they want an option to continue the contribution voluntarily, you may allow it for the salary limiting to Rs. 15k only.
