I am working in a Medical Trust registered under the Bombay Society Act of 1860. Our organization runs a Deemed University, which includes five various teaching colleges, such as a Medical College and Hospital. We have our own certified standing orders.

Applicability of Statutory Acts

I want to know which types of statutory acts are applicable to us. The Factories Act of 1948 states that a factory is where the manufacturing process is carried on with or without the aid of power. However, we provide services and education, including hospital services. So, does the Factories Act apply to us? Please also tell me which other acts are applicable to us. Thank you.

The Factories Act of 1948 primarily applies to premises where manufacturing processes take place. Since your organization is focused on providing services and education, including hospital services, rather than manufacturing goods, the Factories Act may not be directly applicable to your establishment. However, several other statutory acts are relevant to your Medical Trust running a Deemed University in Mumbai, India:

1. Bombay Shops and Establishments Act: This act regulates the working conditions in shops and commercial establishments and may be applicable to your organization.
2. Employees' Provident Funds and Miscellaneous Provisions Act, 1952: If you have more than 20 employees, this act mandates the establishment of a provident fund for your employees.
3. Employees' State Insurance Act, 1948: This act provides social security benefits to employees and their dependents in case of sickness, maternity, disablement, or death due to employment injury.
4. Payment of Gratuity Act, 1972: This act mandates the payment of gratuity to employees upon termination of their employment after completing a certain period of continuous service.
5. Minimum Wages Act, 1948: Ensures that employees are paid at least the minimum wage rate specified for their category of work.
6. Maternity Benefit Act, 1961: Provides maternity benefits to women employees.

It is advisable to consult with legal experts or HR professionals well-versed in Indian labor laws to ensure compliance with all relevant statutes and regulations.
