I am working for a construction company in Telangana. We have been awarded a new project by the government of Telangana. The labor department is requesting a joint undertaking by the contractor and the employer for the payment of minimum wages. Could you please inform us if there is a specific section in the Contract Labor Act or Minimum Wages Act that requires both the contractor and the employer to submit a joint undertaking?

The payment of minimum wages to the contract labour is primarily the responsibility of the contractor. However, sec. 21 of the Contract Labour Act 1970 requires the Principal employer to pay the wages to the contract labour if the contractor fails to pay them. Therefore, the Labour commissioner must be insisting on a joint undertaking.
