Your post seems to be from the United States. Did the incident take place in the US? You need to follow the ID rules of the respective area. In the Indian scenario, for such grievous misconduct, the ID Act governs disciplinary action through a domestic enquiry post suspension of the worker by an unbiased person. All the documents, such as evidences, suspension letters, charge sheets, explanations, etc., should be submitted to the Enquiry Officer for adjudication.

If even a small mistake by a worker is brought to your attention, the appropriate action would be to either suspend or attach him to the office and initiate an inquiry against him.
