If a teacher is on leave from 04/10/2015 to 15/10/2015. He applied for Casual Leave (CL) from 04/10/2015 to 10/10/2015. 11/10/2015 is an off day, and 12/10/2015 is a holiday. His CL balance is nil, so from 13/10/2015 to 15/10/2015, it will be considered as Absent. My question is whether 11/10/2015 and 12/10/2015 will be treated as Absent or Paid holidays.

Leave Rules and Procedures

Casual Leave: Any leave, with prefixes and suffixes. If holidays fall in the middle of the leave, they can be availed as Casual Leave. Sundays can be treated as permission. If Saturdays (for a five-working-day organization), Monday can be availed as casual leave with Prefix Saturday and Sunday as permissions (being declared leaves). Any important holidays can be availed with the casual leave.

Earned Leave: Only prefixes and suffixes can be availed. No other holidays in between can be treated as permissions. All that should be treated as earned leave.

Medical Leave: No permissions required. Up to the date of submitting a fitness certificate, it needs to be regularized according to the organization's rules and regulations or as per the procedure in vogue.

Sick Leave: No permissions required, as per the procedure in vogue.

Bereavement Leave: No permissions needed, according to the procedure in vogue. Rest with the authority who is sanctioning leave or organizational procedures.

Hospital Leave: Exceptional cases in government services, particularly armed forces/subordinate forces.

In this case, you cannot treat leave in continuation as casual leave; all that should be treated or regularized.

So where is the confusion if the application is from 4th Oct to 15th Oct? Whatever EL/PL available balance has to be adjusted, and the rest of the days are to be treated as LWP, including 11th & 12th Oct.

If the employee has applied for leave from 4th Oct to 10th Oct but has joined on 16th Oct, then EL/PL will be counted until the 10th Oct. From 13th Oct to 15th Oct, it will be LWP, i.e., 11th & 12th Oct will be paid leaves.
