Hi,

Can anyone tell me if a holiday falls on a weekend, is compensatory time off given on a weekday? I am in the IT industry, and we have Saturdays and Sundays off. This year, a number of holidays fall on these two days, so I was wondering what the policy is regarding this in IT companies. For example, last year, Diwali fell on a weekend, and a compensatory holiday was given on Monday. Please shed some light on this.

Hi As per law company need not give any compensatory off if a holiday falls on a weekend but if company wishes it can give compensatory off but no compulsion siddharth

Dear all,

I have the same question as Sonia. Is it compulsory for the private sector to declare compensatory off if holidays appear on the weekly off days of Saturday and Sunday?

We are an engineering company in Maharashtra with 10 employees who have Saturday and Sunday as their weekly off days.

As per law, 12 public holidays must include four national holidays. If the company wishes, they may give compensatory holidays on weekdays like any Monday or Friday, depending on the company policy. Since ours is an engineering company, there is no compulsion for compensatory holidays, but we will give one compensatory holiday; it all depends on the company.

Dear Sonia,

It is not mandatory that you have to provide Comp-off for holidays, but I suggest that you please discuss this issue with your top management. For employee satisfaction, try to provide Comp-off for these days.

All companies have different rules. We have holidays only on sundays, and if any holiday falls on sunday, our company gives another holiday in lieu of that. Total 10 holidays are given in a year.

Dear All,

I would like to know how Section 52 and 53 differ from each other. If a worker works on their weekly off (i.e., on Sunday), will they be entitled to a compensatory day off? In this scenario, should the worker be handled according to Section 52 or 53 of the Factories Act? Kindly explain.

National Holidays on Weekly Off Days

If any national holiday falls on a Sunday, which is a weekly off, what is the rule for paying for a national holiday that falls on a Sunday (weekly off)? If it is given as a weekly off, then where is the national holiday? Our company only gives a holiday on the weekly off (Sunday) with 9 holidays considered in a year. Please suggest.

Weekly Off Policies in Private Companies

Also, some companies mandate Saturday and Sunday as weekly offs. Is this mandatory for all private companies, or is Saturday a half-day mandatory? Please suggest.

Hi all,

All organizations are entitled to give 10 holidays in a year, including national holidays. If your organization is giving you 10 holidays a year, then they will not compensate for festival holidays or national holidays that fall on a weekly off. If a national holiday occurs during a weekly off, it has to be paid.
