One of my colleagues has asked me about the available provisions under any Act or any G.O. that can allow the employer to install CCTV cameras in their establishment. This inquiry arises as the union is objecting to the installation of cameras in the shop floor area, while the management desires to proceed with the installation.

There is no such law that regulates the use of CCTVs. It is important to note that if the office feels a security requirement exists, they are at liberty to go ahead. Unions normally object to CCTV as it records employees and their activities, which they feel violates privacy. The board should clearly inform everyone that the area is under electronic surveillance, and this information should be prominently displayed.

Hello Giri,
More than any law, usually CCTVs are installed on instructions from the local police. At least in cities, all shops/factories are suggested to install CCTVs by the police. Check with your local SP. No point approaching the lower police officials for such issues, as you may get misleading/round-about replies.

Dear Nathrao/ Dear Tajsteesh,
Thank you very much for your response. As per the Public Safety Act, the local police advised installing CCTVs at the entrance, exit, and parking area. However, there is resistance from unions to installing them in the shopfloor area. If there are any guidelines from the government or police, it would be easier for us to convince them. Otherwise, the relationship may become strained. We are considering this aspect.

In Tamil Nadu, the guidelines in the following Government Order are to be followed in respect of CCTVs, which might be useful for your purpose if you decide to go ahead with installation.
