Sir, I would like to bring to your kind notice that I, Vijay Kumar Tiwari, S/o Shri Hriday Narayan Tiwari, worked at Enoch Venture Pvt. Ltd., A-75, 3rd Floor, Sector-5, Noida-201301. One month has already passed, but to date, I have not received my salary.

In this regard, I have had many discussions with HR Spoke Ms. Shiwani in the HR department and my ex-team leader Mr. Ram. However, I am not getting any satisfactory answers from them. In fact, they are directly denying helping me.

I would also like to inform you that before leaving the organization, I had already given them prior verbal information regarding my resignation. I also tried to submit my written resignation, which they refused to accept. Now they are saying that they have recorded me as absconding, which is not at all acceptable to me.

I request you to kindly intervene in this matter and help me to get my pending salary for Oct’14. I will be really thankful to you.

Hi Vijay,

Please read the employment agreement, which will provide you with details about the process of resigning. Resignation in writing, whether through email or hard copy, is accepted. If you resigned via email and have a copy of that email, it serves as proof of your resignation. Otherwise, it will be considered as absconding. Additionally, please check if any warning letter was sent to you after you left the company. As per the process, if there is absenteeism for three days, the company is required to issue a warning letter asking you to return to service.

First of all, the forum does not know whether you were a confirmed employee or a probationer, what your termination clause was. Please define this so as to provide an appropriate view.

Secondly, resignation cannot be based on verbal communication; it should always be in writing. Moreover, it is not just an intimation; it should be accepted.

Lastly, with reference to the available information, please speak to the concerned Labor Officer of your area who can guide you further.
