Hi,

I need advice regarding a false complaint framed against me in the Speak Up line by another colleague of mine. Kindly advise on how I should tackle this situation. She has framed a false complaint saying that I am using personal comments on her. She works in Admin and I have noticed many lapses in her work and behavior. She is unprofessional in responding.

There was an initial discussion by HR, but it has been quiet for some time now without any feedback. Kindly advise on how to proceed.

Addressing False Accusations in the Workplace

In order to cover up their weaknesses on professional and other fronts, some individuals start spreading false accusations against their peers to divert attention from themselves. It is advisable to caution such individuals initially. If they do not stop, then inform the higher-ups in detail about the nature of the personality of such a person. If necessary, submit a written complaint. This process will expose the person, and in the future, if they attempt it again, no one will believe them. If necessary, threaten such a person with legal action for defamation.

What is this Speak Up line? What exactly is the nature of personal comments? Is it in writing or verbal? Who has found faults in her work as Admin? What exactly is your position in the organization? Have you taken the matter of comments against you in any official forum/form? Depending on the nature of a comment, only thoughts of further action can be considered. Sometimes comments may be of a type that can be ignored after a mild caution. One has to consider all these factors while acting on comments.

Speak Up Line and Complaint Management

The Speak Up line is an HR facility managed by a third party, our Legal Team, and the HR department of the company. Employees can file complaints for any misconduct by an employee, and complaints regarding any violation of the company code of conduct, etc., are considered in the Speak Up.

I work as a Senior Administrative Assistant in the Business Information Solutions (IT) Department. I serve as the Department Secretary and am responsible for all departmental administrative functions. However, I have observed many lapses in her work myself and have received many complaints from the team regarding her behavioral attitude and work (orally). I have been told by the Dept. Head (who is my immediate manager) to lead in supervising the administrative activities performed by her and another counterpart of mine. As I am held accountable for their activities, I had to give instructions, sometimes stern instructions, to carry on the work, pointing out many lapses and irresponsible behavior observed in her. This is not liked by her, and she framed a false complaint by saying that I shouted at her and made personal comments, such as quoting her as being diplomatic and "bitching." The complaint was filed by her soon after my immediate manager HOD left the services of the company. HR has called me to investigate and questioned me regarding shouting at her, which is not true. It has been quite some time now, and HR has not reverted back to me on the status. I have been working with this company for 12 years with a very senior leadership team, and this is the first time I faced this situation. Please advise on the course of action I should take and what I should be doing for filing a defamation.

Take up the pending complaint with your administrative department. If necessary, document the entire issue in writing and try to obtain written confirmation from the person who has left your organization. Complaints by team members should also be addressed. This will highlight that the Secretary has a habit of misbehaving with others. The Secretary needs to be firmly counseled about her behavior. I do not believe it is worthwhile to pursue a defamation lawsuit.
