Can we appoint a B.Tech Engineer Trainee @ 2000/-PM stipend. I understand this kind of person will not covered under apprenticeship act.

Minimum Stipend for Graduate Engineers

According to our knowledge, the Apprentice Act states that the minimum stipend to be paid is Rs. 3500 for graduate engineers. If the company wishes to pay more, it is their choice. If you appoint a Graduate Engineer Trainee for less than Rs. 3500, you will be doing so at your own risk.

Recruitment and Stipend Guidelines for Apprentices

If you are recruiting with the approval of the apprentice advisor, then you need to pay a minimum of what he specifies. However, if you are recruiting directly, the stipend must be higher than the minimum wages.

Recruitment Options for Trainees

The trainee can be recruited either as an apprentice as per the Apprenticeship Act, and the stipend shall have to be as per applicable rules. It has already been pointed out that the person can be taken as a 'Graduate Trainee'.

Alternatively, the trainee can be hired as a 'Trainee' as per Management's Standing Orders, and you can't pay less than the minimum wages. Employees personally can be held responsible for the faithful observance of standing orders.

Hi Manoj, it is better to enroll your organization under the Apprentices Act with the Regional Apprentice Board of your area. The rates mentioned by DWITS are applicable to apprentices. B.Tech graduates can be engaged as graduate apprentices.

Benefits of Enrolling Under the Apprentices Act

An important part of this statute is that 50% of the stipend paid is reimbursed by the Apprentice Board, which is under the control of the Central Government. The period of apprenticeship is 1 year. Furthermore, such engaged persons will not be treated as employees, and your company will be protected from liabilities under labor laws.
