Amendment to the Karnataka Industrial Establishment Act

The amendment to the Karnataka Industrial Establishment (National and Festival Holidays) Act of 1963 came into effect on September 30, 1997. The Labour Commissioner has directed all industries, commercial establishments, plantations, and others for whom the Act applies to declare ten paid holidays in a year. These ten paid holidays must include Republic Day, Independence Day, Gandhi Jayanthi, May Day, and Kannada Rajyotsava. The remaining five holidays are to be decided upon after achieving a mutual agreement between the employer and the employees.

Previously, approval from the Labour Department was necessary before these holidays could be declared. However, with the new amendment, this approval is no longer required. Employers and employees are now only required to approach the department in the event of a dispute. As a result of this amendment, the number of National & Festival Holidays has increased from nine to ten. Rajyotsava Day is mandatory and should be declared along with the other four National Holidays. It is also advised that a simple intimation to the Labour Department would ensure complete compliance under the Act. The location is Bangalore, India.
