Resolving Unsettled Dues and Employee Rights Disputes: Expert Advice Needed - CiteHR

I worked in a Chennai branch regional office of a Hyderabad-based group of companies. I have several problems with the company and need advice from experts to resolve them. I worked with the company for 9 years (Jan '2003 to Nov '2011). During this period, they transferred my payroll to one of the sister concerns in 2005-06 (only payroll, not other stuff) and then transferred my payroll back to the previous company (i.e., Company A to Company B and back to Company A).

Problems Faced

1. **F&F Settlement:** Even after nearly 2 years, they have not settled my full and final settlement. When I enquired with the Head Office, they said they forwarded the letter to the Branch Office, but the branch manager is not signing the cheque. There is no response to mails or calls. Even the earned leave (EL) is not calculated properly, but I am not in a situation to argue for that.

2. **Gratuity:** The HR Manager mentioned that Gratuity is in a separate account and will be released separately from the F&F settlement. However, they have not settled that either. Query: Since the payroll was split between 2005-06, am I eligible for 9 years of Gratuity or only for the last 5 years? What steps could I take to at least receive it?

3. **PF:** I have three different PF numbers (2 for Company A and 1 for Company B). Two PF forms of Company A have been rejected and returned almost 4 months ago, with no status update or form return. When I inquired, the company stated they resubmitted it. The PF form of Company B was not submitted because they claimed the company was closed.

I am tired and frustrated with the employer. Every time I call Hyderabad, I receive responses like they are not at their desk, in a meeting, or on leave. What actions can I take to receive my money? I appreciate any expert advice and help.

Steps to Resolve Outstanding Settlements

Please send a politely worded letter to the MD/CEO of the company, detailing all your outstanding settlements post your exit. Send this letter through Speed Post. Track the delivery of the article sent by Speed Post and keep a printout of the delivery record for future reference.

Request a reply from the MD/CEO and provide your mailing address. In case no reply is received or your dues are not settled within a month, consult an expert and send a legal notice to the company.
