while we are taking long leave in means 15days like that then in that sunday include then how calculate leave days pls tell me

It depends on the type of leave availed and the company's leave rules. Generally, for casual leave (CL), the weekly off and festival holidays will not be counted towards the total leaves taken. However, the rest of all such offs are to be considered for the calculation of leaves availed by the employee.

It depends on the company's leave policy. If, as per the policy, weekends and holidays falling within the leave period are not taken into consideration for the calculation of total leaves, then they will not be counted. In other cases, they will be taken into consideration.

If Sunday falls between the leave dates, then that Sunday is also considered as leave or loss of pay. This is because the salary will be calculated for 30 or 31 full days in a month. So, if you are continuously present for work, you will be paid for the entire 30 days. If you take 15 days of leave, which includes 2 Sundays, then those Sundays will also be considered as leave or loss of pay.

Understanding Long Leave: Privilege Leave or Leave with Wages

The long leave is called privilege leave or leave with wages. These leaves are granted under the Factories Act (FA) if applicable, or else under the Shops and Establishment (S&E) Act.

Under the Factories Act, you are entitled to one day of leave for every 20 days of working. Under the Shops and Establishment Act, 21 days of leave with wages are given annually.

Calculating Leave for Different Employee Types

For daily-rated workmen employed in a factory, the 20 working days are the actual working days. In this scenario, intervening Sundays or weekly offs, which are unpaid, are not considered as leave with pay.

For monthly-rated employees, leaves are calculated based on the total working days, including Sundays, weekly off days, or holidays for which they are paid. In this case, intervening Sundays, weekly off days, or holidays are considered as leave with wages.

I totally agree with Mr. K. Keshav. The long leaves are called "Privilege Leaves." Other leaves like Casual Leave and Sick Leave are subject to the conditions of the company and as per their leave policies. The Casual Leaves and Sick Leave, if sanctioned for a longer period, as you said for 15 days, include the intervening Sundays and holidays, which are also counted as leaves. If leaves are not in credit, then the balance days will be treated as loss of pay or leave without pay. The privilege leaves are mandatory, as explained by Mr. K. Keshav. When a person is availing of privilege leaves, Sundays and holidays are not counted as leave.

Let me correct what I said. I mentioned that for daily-rated employees, intervening Sundays or weekends should be treated as Sundays or weekends (not as leave). For monthly-rated employees, intervening Sundays or weekends should be treated as leave. It is the duty and function of HR to document all such rules and regulations clearly in the form of an HR Manual to avoid any ambiguity.

Yes, dear, I also agree with this because this is a standard to calculate salary days. If an employee takes a long leave, Sunday is included in their leave, but in the case of earned leave (EL), Sunday is not included in their leave.

if you have availed any leave on both sides of weekend , obviously the weekends will aslo be added as leave

hi, The salary not counted for 30 days its counted for 26days except weekly off.so if you take long leave the sunday will not count. by williams
