Dear Sir/Madam, please solve my query. If any employee leaves the factory one hour before his duty time because the next day he needs to join duty at another location for one day, which is nearer to his hometown, and he went first to his home by train, during which he met with a small accident on the train and was absent for 14 days due to the injury, is this accident considered as occurring on official duty? Please suggest.

As per the Employee's Compensation Act, an employee can claim compensation if an accident occurs within one hour after the duty hours of the employee and before one hour of the start of duty hours, provided it falls within the normal route from home to the workplace.
