We are a Facility Management company registered under the Shop & Establishment Act. The issue we are facing is that some of our employees are deployed at a hospital, and our client is demanding that we pay minimum wages to our employees as applicable to the hospital industry and not as per the Shop & Establishment Act. Can anyone guide me on the exact rule under labor law?

Dear Vivek, Your client had suggested you rightly. For determining the Minimum Wages payable,you need to refer to industry,schedule employment and state of deployment.Please do accordingly.

Hospitals are enumerated at entry no: 26 in the Schedule appended to the Minimum Wages Act, and the State of Maharashtra notifies minimum wages skill-wise for the hospital industry. You can obtain the wages from the Government website.

First, you should pay the minimum wages to the employees that have been updated by the government. They are classified into three types:

- Unskilled - $3400
- Semiskilled - $3450
- Skilled - $3500

Most companies are providing $3500 as the minimum wage.
