I was working with an education institute for the past 7 years, which is recognized under the state government, and the salary scales are according to the government. After resigning from my job, I inquired about my gratuity. However, the HR and management refused to process the payment, stating that the state government rule has been amended, and gratuity is now only paid after 10 years of service. Interestingly, during the same period, my brother changed his job after 5.6 years in a PSU, and he received his gratuity. Can anyone help me understand the gratuity act? What are the rules, and has there been any recent government amendment regarding this?

Hi Suneeta, thanks for the info. In my case, the company is refusing to pay gratuity. My total working years are 7. What options or actions can be taken against the company for my gratuity claim?
