My company hired a candidate 1.5 years ago on a CTC basis. The candidate was receiving CL/EL until last month. However, now my company is stating that since the candidate was finalized on CTC, they are not entitled to EL. Can anyone confirm if candidates who are finalized on CTC are not entitled to EL? The manager who finalized the candidate's salary did not inform them of this at the time of joining. Please reply.

Though leaves cannot be claimed as a matter of right, at the same time, employees are entitled to CL and EL. It is up to the Leave Sanctioning Authority to grant leave as per the employee's requirement, ensuring that the work does not suffer. Generally, 30 EL and 8 CL per annum need to be granted, apart from Medical Leaves. If any clarification is needed, please reply.

Employee Leave Entitlements Under Labor Laws

As per labor laws, a confirmed employee is eligible for 7 Sick Leaves (SL), 7 Casual Leaves (CL), and 15 Earned Leaves (EL) per year. The company can't ignore paying these leaves to an employee as it is a statutory compliance.

Apart from these leaves, it is also a statutory requirement to provide 3 national holidays and 4 other festival holidays to an employee. The applicable acts are the Factory Act, Shop and Establishment Act, National Holidays Act, and Casual Festival Act, etc.
