Relevant Legal Sections for Working Hours

Please refer to Sections 28 and 29 of The Building and Other Construction Workers (Regulation of Employment and Conditions of Services) Act, 1996.

Also, refer to Section 1(4) of The Building & Other Construction Workers (Regulation of Employment & Conditions of Service) Act, 1996.

Refer to Chapter VI - Sections 63 - 66 of the Factories Act.

As per the Factories Act, the usual working hours are 8 hours a day with an additional 2 hours of overtime per day (OT - not exceeding 12 hours a week and 50 hours a quarter). The maximum usual working hours may be 9 in case of a 5-day working week (48 hours a week). Please refer to Section 64 of the Factories Act, where, upon obtaining special permission, 75 hours of overtime may be granted after approval from the labor department.

Methods for Employee Monitoring

There are many ways to monitor employees. It depends on the level of sophistication you have available.

At the base level, you can do manual monitoring. Have the security officer or shift supervisor send a list of employees with log-in and log-out times, and have one person in HQ feed it into a system, spreadsheet, or attendance software.

Alternatively, you can put up biometric machines at each site and have the data collected each day or week and sent to HQ for processing. There will be other methods in the middle. You need to choose based on your requirements and how much cost (capital expenditure and recurring) you are willing to incur.
